NOTICES OF PUBLIC HEARINGS

ZONING BOARD OF APPEALS TOWN OF ELLICOTTVILLE, NEW YORK

Notice is hereby given that, pursuant to Sections 267, 267-a, and 267-b of New York State Town Law, the Town of Ellicottville Zoning Board of Appeals will hold a public hearing on Thursday, April 3, 2014 at 6:00 P.M. in the Ellicottville Town Hall, One West Washington Street, Ellicottville, New York, to consider:

ZBA-2012-02, the application by Patricia Overell for several area variances, which are needed in order to allow an existing duplex to be split along a common wall into two single-family lots.  The lot is located at 6777 NYS Rte 242 West and is further identified as Tax Map Number 55.002-1-17.1.   The Town of Ellicottville Planning Board may also hold a public hearing on the proposed lot split; a notice of that public hearing would be provided at a  later date.

The Zoning Board of Appeals will consider these variances:

A variance to allow the lot to have a minimum of 13,999 square feet, where Section 3.5C(1) of the Town’s Zoning Law requires a minimum lot size of 15,000 square feet.

A variance to allow the existing duplex building to come to within 13.9 feet of the east property side lot line and to within 14.82 feet of the west property side lot line, where Section 3.5D(3) requires a minimum 15 foot setback on each side.   This is a variance of 0.18 feet (about 2 inches) on the west property line and a variance of 1.1 feet on the east  property line.  No additions are proposed to the existing structure.

A variance to allow 26% of the lot to be dedicated to usable open space, where Section 3.5F of the Town’s Zoning Law requires a minimum of 50% usable open space for residential lots.

A variance to allow the parking area for cars to come to within 1.93 feet of the front property line, where Section 3.9B requires such parking to comply with the minimum building front yard setback, which is 35 feet.

The Zoning Board of Appeals will hear all interested persons at the public hearing.  Persons wishing to do so may submit written comments at or prior to the public hearing.  Application materials are available for review at the Town Hall, One West Washington Street, from 9:00 a.m. to 4:00 p.m. Monday through Friday.

 

VILLAGE OF ELLICOTTVILLE

PLEASE TAKE NOTICE that the Village of Ellicottville Board of Trustees, by official Resolutions adopted February 10, 2014, as amended on March 10, 2014, moved to initiate consideration of adoption of the update of the Zoning Local Law of 2009 by introduction of a proposed “Local Law No. 2 of the Year 2014”, entitled “A Local Law Amending Local Law No. 3 of 2009 – Zoning Local Law as previously amended by Local Law No. 1 of the Year 2011 and Local Law No. 2 of the Year 2012”.

The proposed law modifies the existing zoning law by revisions to Section 3-A of the Zoning Local Law by adding a Village Commercial District – 3A (VC-3A) to allow for the reuse of a former industrial/manufacturing building located at 16 Martha Street (Tax ID 55.036-2-36) for residential apartments to enhance and foster the continuation of the visual character, scale, and vitality of the Village, to provide for those uses that may be compatible in scale or use with Village infrastructure and municipal services, and to encourage the preservation of existing structures within the District.  Also revision of the Zoning Map to set forth Village Commercial District – 3A (VC-3A) and to rezone a portion of 16 Martha Street as Residential Development District – Medium Density (MD).

The provisions of the proposed amendments to the currently adopted Zoning Local Law of 2009 of the Village of Ellicottville are intended as the continuation of the current zoning laws, ordinances and resolutions, and will be reaffirmed by the adoption of this proposed local law.  To the extent of any modifications or changes to the existing local law, ordinances and resolutions contained in this local law, such changes shall be deemed to be effective as of the effective date of enactment of this local law.

THEREFORE, pursuant to the Village Law and the Zoning Local Law of 2009 (Section 21), a public hearing shall be held before the Village of Ellicottville Board of Trustees at the Ellicottville Town/Village Hall, 1 West Washington Street, Ellicottville, New York at 6:00 P.M. on the 14th day of April, 2014, for the purpose of considering the adoption of proposed Local Law No. 2 of the Year 2014 entitled, “A Local Law Amending Local Law No. 3 of 2009 – Zoning Local Law as previously amended by Local Law No. 1 of the Year 2011 and Local Law No. 2 of the Year 2012” and hearing all persons interested in the proposed Local Law No. 2 of the Year 2014.  A copy of the aforesaid proposed Local Law is available at the Office of the Village Clerk for inspection by any interested person during business hours.

TAKE FURTHER NOTICE that such public hearing will be held for the further purpose of soliciting public comment on the proposal contained in Environmental Assessment Forms prepared in regard to such Zoning Local Law by the Village Engineer and filed with the Village Board of Trustees that the adoption of such local law will not have significant impact on the environme
